DELIVERY SCHEDULE: One week from date of event. CANCELLATION FEE: Cancellation of services may result in loss of income for the photographer because of inability to re-book the date. The closer the cancellation is to the date of the event, the less likely it will be booked. The photographer will attempt to re-book the date. The following cancellation fees are based on the likelihood that the date will not be booked. If the photographer is able to book another event of equal or more value on that date, all fees paid minus the retainer will be returned. If the Client reschedules the event for a future date and Axel Media Solutions is able rebook their original date, all fees paid will be applied to the new date. Otherwise, the Client will be subject to a rebooking fee. In the event of cancellation, the following fees are due: 100% of the total amount due for cancellation within 60 days of the event date; 60% of the total amount due for cancellation within 60 to 90 days of the event date; and loss of retainer for cancellation over 180 days from the event date. CLIENT RESPONSIBILITY: If the Client would like photographs of specific subjects, the Client or a designee of the Client will be responsible for identifying and gathering these subjects for the photographer. HOUSE RULES: The photographer may be limited by the guidelines of the hotel site management. Client agrees to accept the technical results of any imposition on the photographer. Negotiation with the officials for moderation of guidelines is the Client’s responsibility. Axel Media Solutions will offer technical recommendations only. ADDITIONAL COVERAGE: If the Client wishes to add additional hours of coverage at the event, it will be billed to the client as follows. If one photographer is requested, a fee of $200 per hour will be assessed to the Client. The Client must pay all overtime fees with in one week of the wedding. The overtime fee includes photography at the event, post event editing and additional images added to the proof book and DVD. LIMITATION OF LIABILITY: Axel Media Solutions will take the utmost care with respect to the making, processing, and delivery of photos. The photographer will not be held responsible for any errors made by either film, digital negatives (CF cards) and print processor or film manufacturer, except for the reimbursement of a proportionate amount of the contracted fees, appropriate to the loss. The Client further agrees, to the fullest extent permitted by law, to limit the liability of Axel Media Solutions, their owner(s) and employees for the contracted event for any and all claims, losses, costs, damages of any nature whatsoever or claims expenses from any cause or causes, including attorneys’ fees, costs, expert witness fees and costs, so that the total aggregate liability of Axel Media Solutions shall not exceed the total fee for services rendered for this event. Because this is an uncontrolled event, Axel Media Solutions cannot guarantee delivery of any specifically requested image(s). In the unlikely event of personal illness or other circumstances beyond the control of Axel Media Solutions, a substitute photographer of high qualifications, subject to acceptance by the Client prior to the event, may be dispatched by Axel Media Solutions to fulfill the obligations of photography herein contracted. If a substitute is unavailable or is declined, a full refund of all retainers and fees will be made. In the event that weather conditions make travel unsafe and the event is postponed, the photographer will reschedule for the new date, if available. If unavailable, or if the photographer deems travel to be unsafe even though the wedding still occurs, the photographer's liability will be limited to the return of all fees paid. COPYRIGHT AND REPRODUCTIONS: Client will have the permission to reproduce all images. Photographer shall be allowed to make reproductions for the Photographer's portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, advertising, illustration, editorial use, or for display within or on the outside of the Photographer's studio, including printed materials, media on the Web, and any current or future digital media. The client may request that Axel Media Solutions keep all of their event images private. This contract is not valid until it is signed and Axel Media Solutions has received the retainer. By completing the following information it is understood that you have read and agree to the terms of this agreement.
